Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website https://giscourse.online (the “Platform”) and all content, courses, scripts, software, and services made available through it (collectively, the “Services”).

The Platform is owned and operated by Marcel Abel Cedrez Dacosta, an individual carrying on business under the trade name “GeoRGB” (“GeoRGB”, “we”, “us”, “our”), based in the Province of Alberta, Canada.

By registering for an account, subscribing, downloading any script, viewing any lesson, or otherwise using the Services, you (“you”, “the User”) agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Nature of the Services

GeoRGB provides educational content and specialised software tools in the fields of geostatistics, geographic information systems, and the geosciences. The Services consist principally of:

  • Scripts — R-based processing scripts designed to run within QGIS via the QGIS R provider, made available to you as downloadable files;
  • Courses — video lessons and supporting educational material delivered by streaming through the Platform.

All content and software on the Platform is created and provided solely by GeoRGB. The Platform does not host third-party instructors, and no third party has the right to publish, sell, or distribute content through it.

GeoRGB is not an educational institution and does not issue accredited qualifications, academic credit, or professional certification of any kind. Any certificate of completion issued by the Platform is a record of participation only.

The Platform is operated in English. Course content may be provided in English or Spanish.

2. Eligibility and Accounts

You must be at least 18 years of age to create an account and subscribe to the Services. By registering, you represent that you meet this requirement.

You must provide accurate and complete information when registering and keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

Accounts are personal and non-transferable. You may not share, sell, lend, or otherwise permit any other person to use your account credentials. Each account is licensed to one named individual.

You must notify us promptly of any unauthorised use of your account at admin@giscourse.online.

We may suspend or terminate any account that we reasonably believe has been shared, used in breach of these Terms, used for unlawful purposes, or obtained through fraudulent means.

3. Subscription, Fees and Billing

3.1 Structure

Access to the Services is provided through a paid subscription:

  • An initial enrolment fee of USD 35, which includes your first month of access; and
  • A recurring fee of USD 15 per month thereafter.

All prices are stated and charged in United States Dollars and are exclusive of any taxes that may apply.

3.2 Billing cycle

Your first recurring charge is applied one month after the date of your initial enrolment, and monthly thereafter on the corresponding date of each subsequent month. Where a month does not contain the corresponding date, the charge is applied on the last day of that month. The number of days in a billing period will therefore vary.

By subscribing, you authorise us and our payment processor to charge your designated payment method on a recurring basis until you cancel.

3.3 Payment processing

Payments are processed by third-party payment service providers. Stripe is currently used for this purpose. We do not collect or store full payment card numbers or card authentication data. Your use of a payment processor is subject to that provider’s own terms and privacy policy.

If a payment fails, we may retry the charge and may suspend access until payment is successfully processed.

If you pay in a currency other than US Dollars, your bank or card issuer may apply currency conversion charges or foreign transaction fees. These are outside our control and are your responsibility.

3.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting admin@giscourse.online. Cancellation takes effect at the end of the current paid billing period. You will retain access until that date and will not be charged again.

If you cancel and later wish to subscribe again, you must pay the initial enrolment fee of USD 35 once more. Reduced or waived re-enrolment is not available.

3.5 Price changes

We may change subscription fees. We will give you at least 30 days’ notice by email before any change takes effect for your subscription. If you do not accept the new price, you may cancel before it takes effect.

4. Refunds and Right of Withdrawal

All fees are non-refundable, except where a refund is required by applicable mandatory law.

The Services consist of digital content and downloadable software supplied immediately upon subscription. Where you are a consumer resident in a jurisdiction granting a statutory right of withdrawal or cooling-off period for distance contracts (including the European Union and the United Kingdom), you expressly agree that performance of the contract begins immediately upon your subscription, and you expressly acknowledge and consent that you lose your right of withdrawal once you download any script or begin viewing any lesson.

You are asked to confirm this acknowledgement separately at the point of purchase. If you do not wish to give it, do not subscribe.

Nothing in this section limits any right you may have to a refund where the Services are not supplied as described, or where a refund is otherwise required by mandatory consumer protection law.

5. Licence to Use the Scripts

5.1 Grant of licence

Subject to your compliance with these Terms, GeoRGB grants you a limited, non-exclusive, non-transferable, non-sublicensable, worldwide licence to install and use the scripts you download during an active subscription period, for your own professional or personal work, including work carried out internally within the organisation that employs you.

The scripts are licensed to you, not sold. GeoRGB retains all intellectual property rights in them.

5.2 Continuation after cancellation

The licence granted in clause 5.1 in respect of scripts you have already downloaded during an active subscription period is perpetual and survives cancellation of your subscription, subject to your continued compliance with these Terms.

However, upon cancellation you immediately lose:

  • access to the Platform and to all streamed course content;
  • access to any scripts you had not downloaded before cancellation;
  • access to any new scripts, modules, updates, corrections, or new versions released after cancellation;
  • access to any support or communication channels reserved for subscribers.

Your subscription therefore purchases continuing access to an expanding body of work, not merely the files you hold at any given moment.

5.3 Restrictions

You must not, and must not permit any other person to:

  • copy, reproduce, or distribute any script except for reasonable backup purposes;
  • publish, upload, post, or otherwise make any script available on GitHub, GitLab, Bitbucket, any other public or private code repository, file-sharing service, shared drive, forum, mailing list, social network, or any other channel;
  • sell, resell, rent, lease, lend, sublicense, assign, or otherwise transfer any script or your rights under this licence;
  • modify, adapt, translate, decompile, reverse-engineer, or create derivative works based on any script;
  • remove, obscure, or alter any authorship notice, copyright notice, licence header, or attribution contained within any script file;
  • use any script, in whole or in part, to develop, train, or offer any product or service that competes with the Services;
  • use any script to provide a commercial processing, consulting, or bureau service to third parties in which the script itself constitutes the service being sold, as distinct from using the script as a tool within your own professional work;
  • use any script or its outputs as input to train, fine-tune, or evaluate any machine learning or artificial intelligence system.

Nothing in this clause restricts any act that cannot lawfully be restricted under applicable law.

5.4 Free modules

Certain modules may be made available at no charge, whether or not in exchange for registration of an email address. Such modules are licensed, not given away, and all restrictions in clause 5.3 apply to them in full.

5.5 Technical compatibility

The scripts are designed to operate within specific versions of QGIS, R, and associated packages. GeoRGB does not warrant that any script will function with any past or future version of QGIS, R, any R package, any operating system, or any other third-party software, and is under no obligation to maintain compatibility with them.

You are responsible for ensuring that you have the hardware, software, and internet access necessary to use the Services.

6. Licence to Access the Courses

Subject to your compliance with these Terms, GeoRGB grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and view course content through the Platform, for your personal, non-commercial educational use, for the duration of your active subscription.

You must not download, record, screen-capture, copy, reproduce, republish, transmit, broadcast, or otherwise make available any course content, in whole or in part, by any means.

Access to a course does not grant any licence to any script. Scripts are licensed only under clause 5, and only where they have been downloaded during an active subscription period.

Where you purchased a course from GeoRGB before the date of these Terms under terms granting lifetime access to that course, that access continues in accordance with the terms in force at the time of your purchase, in respect of that course only. Such prior purchases do not grant any right to the scripts, to the subscription, or to any other content.

7. Professional Use, Disclaimer of Warranties and User Responsibility

This clause is important. Please read it carefully.

The scripts produce geostatistical estimates, model outputs, diagnostic statistics, and automated reports. These are analytical tools intended to support the judgement of a qualified professional. They are not a substitute for professional judgement, and they do not constitute professional advice of any kind — geological, hydrogeological, environmental, engineering, regulatory, financial, or otherwise.

You are solely responsible for:

  • determining whether any script and any method it implements is appropriate for your data, your site, and your objectives;
  • independently verifying and validating all inputs, parameters, assumptions, and outputs;
  • ensuring that any use of the outputs in a regulated, professional, commercial, or legal context is reviewed and approved by a suitably qualified and, where required, licensed or registered professional;
  • compliance with all professional, regulatory, permitting, and reporting obligations applicable to your work.

GeoRGB does not review, approve, endorse, or take responsibility for any analysis, report, assessment, decision, or deliverable that you produce using the Services.

THE SERVICES, INCLUDING ALL SCRIPTS, COURSES, CONTENT AND OUTPUTS, ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEORGB DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, ACCURACY, TITLE, AND NON-INFRINGEMENT.

GeoRGB does not warrant that the Services will be uninterrupted, error-free, or free of defects, that any script is free of bugs, or that any output is accurate, complete, or suitable for any particular purpose.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

GeoRGB shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, opportunity, goodwill, or anticipated savings, arising out of or in connection with the Services, whether in contract, tort (including negligence), statute, or otherwise, and whether or not GeoRGB was advised of the possibility of such damages.

Without limiting the foregoing, GeoRGB shall not be liable for any loss or damage arising from any decision, assessment, report, remediation design, regulatory submission, or other professional deliverable made or produced by you or any third party in reliance on any output of the Services.

GeoRGB’s total aggregate liability arising out of or in connection with the Services, from all causes of action and under all theories of liability, shall not exceed the total amount of fees actually paid by you to GeoRGB in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not permit the exclusion or limitation of certain warranties or damages; in those jurisdictions, the exclusions and limitations above apply only to the extent permitted.

9. Indemnity

You agree to indemnify, defend, and hold harmless GeoRGB and Marcel Abel Cedrez Dacosta from and against any claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Services, your breach of these Terms, your infringement of any third-party right, or any professional deliverable you produce using the Services.

10. Intellectual Property

The Platform, the scripts, the courses, all associated documentation, reports, graphics, logos, and the names “GeoRGB”, “GeoRGB Community”, and “giscourse.online” are owned by GeoRGB and are protected by copyright, trademark, and other laws.

Except for the limited licences expressly granted in clauses 5 and 6, no right, title, or interest in or to the Services is transferred to you.

If you believe that any material on the Platform infringes your intellectual property rights, please contact admin@giscourse.online with sufficient detail to identify the material and the right concerned.

11. User Content

The Platform may allow you to submit reviews, questions, comments, or other material (“User Content”). You retain ownership of your User Content.

By submitting User Content, you grant GeoRGB a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, adapt, publish, display, and distribute it in connection with the operation and promotion of the Services. This licence continues after your subscription ends in respect of User Content already published. You may request removal of your User Content at any time by contacting us.

You represent that you hold all rights necessary to grant this licence and that your User Content does not infringe any third-party right or breach any law.

You must not submit User Content that is unlawful, defamatory, harassing, obscene, misleading, or that infringes the rights of others. GeoRGB may remove any User Content at its discretion and may suspend or terminate the account of any User who repeatedly or seriously breaches this clause.

12. Acceptable Use

You must not:

  • use the Services for any unlawful purpose or in breach of any law applicable to you;
  • attempt to gain unauthorised access to the Platform, any account, or any system connected to it;
  • interfere with or disrupt the operation of the Platform, including by introducing malicious code;
  • use automated means to scrape, harvest, or systematically download content from the Platform;
  • circumvent, disable, or attempt to defeat any access control, authentication, or content protection measure.

You are responsible for knowing and complying with the laws applicable in your own country, including any restrictions on the import or use of software.

13. Availability, Changes and Termination

We aim to keep the Platform available continuously but do not guarantee uninterrupted access. Access may be unavailable due to maintenance, technical faults, third-party service failures, or circumstances beyond our reasonable control, including force majeure events, power failures, network outages, and malicious acts by third parties. We will take reasonable steps to restore access within a reasonable time.

We may modify, add to, or discontinue any part of the Services at any time. Where a change materially reduces what your active subscription provides, we will give reasonable notice by email, and you may cancel.

We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, if payment is not made when due, if required by law or by a competent authority, or where we reasonably consider it necessary to protect the Services or other Users. Where the circumstances allow, we will give notice and an opportunity to remedy the breach.

On termination for breach, the licence granted in clause 5 terminates and you must cease all use of the scripts and delete all copies in your possession.

Clauses 5.3, 7, 8, 9, 10, 11, 14 and 15 survive termination of these Terms.

14. Changes to These Terms

We may amend these Terms from time to time. The date of the most recent update is shown at the top of this page.

Non-material changes take effect on the date they are posted. Material changes take effect 30 days after they are posted, and we will notify active subscribers by email. If you do not accept a material change, you may cancel your subscription before it takes effect. Continued use of the Services after a change takes effect constitutes acceptance of the amended Terms.

15. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them or the Services are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

You agree to submit to the exclusive jurisdiction of the courts of the Province of Alberta, and you waive any objection to those courts on grounds of venue or inconvenient forum.

You agree to bring any claim in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

If you access the Services from outside Canada, you do so on your own initiative and are responsible for compliance with local law. Nothing in this clause deprives a consumer of the protection of mandatory provisions of the law of their country of habitual residence where those provisions cannot be derogated from by agreement.

16. General

These Terms, together with the Privacy Policy and any additional terms presented at the point of purchase, constitute the entire agreement between you and GeoRGB in respect of the Services.

If any provision is held to be invalid or unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force.

Our failure to enforce any provision does not constitute a waiver of it.

You may not assign or transfer your rights under these Terms. GeoRGB may assign these Terms in connection with a reorganisation, merger, or sale of all or substantially all of its business or assets.
