Terms of Use

These Terms of Use were updated on January 30, 2021.

  1. General:

The objective of the GeoRGB Community (GRC) is to provide to the GRC users (students and instructors) the best experience when doing online courses.

GRC uses the website https://giscourse.online (the GRC platform) as a learning and teaching platform, for the users.

When users have an account in the GRC platform, they can enroll to the offered catalog of courses.

GRC allows skilled science instructors to create and share online courses from anywhere around the world to students anywhere in the world.

The users agree and acknowledge that GRC is not an educational institution and the propose of the GRC is the commercialization, paid or free, of virtual products between instructors and students.

English will be the language for the GRC platform. However, courses and other services will be in English or Spanish, depending on instructor’s preferences.

The users agree that by registering, accessing, or using the GRC platform and its services, the users are agreeing to enter into a legally binding contract with GeoRGB Community. If the users do not agree to these Terms of Use, they cannot register, access, or otherwise use any of services provide by the GRC platform.     

  1. Account:

In order to access the GRC platform, the users have to sign up a GRC account and create a password in the GRC platform (https://giscourse.online).

The users have to keep the password somewhere safe, because they are responsible for all activity associated with their accounts.

Any irregularity in an account has to be reported to GRC at admin@giscourse.online.

All the users must be 18 years old to sign up for a GRC account.

For users younger than 18, we encourage the parents or guardians to open an account and help the users enroll in the courses; parents or guardians will be responsible for GRC accounts in these cases.

The users can rectify, modify, cancel or delete their account any time by contacting admin@giscourse.online.

GRC does not assume any responsibility or liability of any kind for inadequate use of a GRC account. 

The users are prohibited from sharing their accounts with others.

The users are responsible for what happens with their account and GRC will not intervene in disputes between students or instructors who have shared account login credentials.

GRC has the right to terminate, partially or totally, any GRC account due to improper use of it, under the GRC criteria.

In the case that GRC cancels an account, GRC may request some information from the user to confirm that the user is indeed the owner of his/her account. When the user cannot provide the account ownership, GRC has the right of account termination without any possibility of refunds or any other type of compensation.

  1. Course Enrollment and Access to the Courses:

Once an instructor loads a course on the platform, the instructor grants GRC a license for the course. Then, GRC sublicenses this licence, free or paid, to the enrolled student.

When the users get enrolled in a course, the users will get the license of the course to access and view the course through the GRC platform and not through other use.

When the users get enrolled in a course, they are getting the license to view the course, they do not buy the course. This licence is limited to personal use, non-exclusive, non-transferable, non-sublicensable and non-commercial.

When the users get enrolled in a course they are not allowed to reproduce, redistribute, transmit, transfer, assign, sell, broadcast, resell, rent, share, lend, modify, adapt, edit, market or monetize any course in any manner, it will be considered a violation of the Policy, Terms of Use, and author rights.

Only the owner of the course can manipulate the content of it, or people with explicit authorization to do so.

Instructors may not grant licenses to their courses to students directly, and any such direct license shall be null, void, and a violation of this Terms of Use.

GRC provides lifetime access license to the users after getting enrolled in a course.  However, GRC reserves the right to revoke any license to access and use any course at any point in time, in the event where GRC decides or is obligated to disable access to a course due to legal or policy reasons, or if GRC determines its content is inadequate to be shown on the GRC platform. The lifetime access to the course will be changed after the instructor decides to remove his/her content from the GRC platform; when it happens the enrollment option of the course will be closed immediately and the user will have 60 extra days to finish the course. 

GRC provides a lifetime access license to the users after getting enrolled in a course, but just to the course, GRC cannot guarantee unlimited access to the instructor. 

  1. Access to the Platform and Modifications:

GRC provides the courses to the users on a continuous basis.

GRC will take all reasonable efforts to provide uninterrupted access to the platform. However, from time to time, the users may be unable to access the platform due to conditions beyond GRC’s control. Such conditions include, but are not limited to: force majeure, power outages, and the acts of computer hackers and others acting outside the law.

From time to time, access may be unavailable due to software issues, server downtime, increased Internet traffic or downtime, programming errors, regular maintenance of the system, and other related reasons.

 In response to any unavailability of the platform to the users, GRC will take all reasonable measures to ensure access is restored within a reasonable period of time.

GRC reserves the right, in their sole discretion, to change, modify, or discontinue any aspect or feature of the platform in whole or in part, including, without limitation, the content, availability, access and/or the Terms of this platform.

The users are responsible for ensuring that they have sufficient and compatible hardware, software and internet service necessary for use of the platform and completion of the courses.

  1. Payments and Refunds:

Courses on GRC can be free or paid.

The prices of courses on GRC are determined based on the terms of the Instructor Terms and cannot be higher than 100 United States (US) Dollars.

The users who purchase courses with a currency other than US Dollars should understand that when paying with a credit or debit card, a commission may be charged from the user’s bank for foreign currency exchange and the price the student will pay for the course may be higher than the one shown at the GRC platform. GRC recommends that the users request information from their banks before processing any payment.

The users interested to buy a course on the platform have to process the payment through https://giscourse.online website exclusively. GRC does not collect money through third parties or other websites.

GRC process the payments through PayPal and Stripe, and not other payment method is available.

Prices of the courses are showing exclusively in US Dollars.

The users agree to pay the fees for the courses that they purchase, and they authorize GRC to charge their debit or credit card for those fees. GRC works with third party payment processing partners (PayPal and Stripe) to offer the users the most convenient payment methods in their countries and to keep their payment information secure.

Refunds are only available when a license of a course is revoked to access and use it due to legal or policy reasons and the user did not have enough time to complete the course.

GRC is open to discuss a refund in exceptional conditions, exclusively under the criteria of GRC.    

  1. Content Rules:

The users can only use GRC for lawful purposes.

The users are responsible for all the content that they post on the GRC platform.

All content posted on the GRC platform (reviews, questions, posts, courses, etc.) has to be in agreement or accordance with the law, and respect the intellectual property rights of others.

GRC can ban your account for repeated or major offenses.

If someone thinks there is infringing copyright on the platform, let GRC knows at admin@giscourse.online

The users may not access, use the platform, or create an account for unlawful purposes.

The use of the GRC platform and the behavior of the users in the platform must comply with applicable local or national laws or regulations of the users’ country. The users are solely responsible for the knowledge of and compliance with such laws and regulations that are applicable in their countries.

The students are not allowed to post or submit anything that is not his/her and it comes from the GRC platform.

The instructors can submit courses for publication on the platform and can also communicate with the students who have enrolled in their courses. In both cases, instructors must abide by the law and respect the rights of others: instructors cannot post any course, question, answer, review or other content that violates applicable local or national laws or regulations of their country.

The instructors are solely responsible for any courses, content, and actions they post or take via the GRC platform and services and their consequences.

 The instructors have to make sure that they understand all the copyright restrictions set forth in the Instructor Terms before they submit any course for publication on the GRC platform.

GRC complies with copyright laws.

GRC may remove a specific content or full course from the GRC platform if the content violates the law or the rights of others, if the content or behavior is unlawful, inappropriate, or objectionable under the GRC criteria.

RGC may terminate or suspend the permission to use the GRC platform and services or ban any account at any time to any user, with or without notice, for the following reasons: Terms of Use are considered to be violated, failing to pay the fees when due, upon the request of law enforcement or government agencies, for extended periods of inactivity, for unexpected technical issues or problems, if GRC suspects that a user engaged in fraudulent or illegal activities, or for any other reason in GRC’s sole discretion.

Upon any such termination GRC may delete the user’s account and content, and GRC may prevent the user from further access to the platforms and use of GRC’s services.

The users agree that GRC will have no liability to the users or any third party for termination of the users account, removal of the users’ content, or blocking of the users’ access to the GRC platform and services associated with it.

  1. Users Content

The users retain ownership of the content they post or publish on the GRC platform.

When users submit or post any kind of content in the GRC platform, they grant GRC a worldwide, non-exclusive, royalty-free licence, as well as the right of sublicense, to use, copy, process, distribute, publish, modify, transmit, display, and reproduce any users’ content in any media or distribution methods, included the name and image of the users. The users will renounce to any rights of privacy, publicity, or other rights of a similar nature applicable to all these uses, to the extent permissible under applicable law. GRC will consider that the users represent and warrant that they have all the rights and authority to authorize GRC to use the submitted content. The users also agree to all such uses of their content with no compensation paid to them.

  1. Use the GRC platform at Your Own Risk Disclaimers

Anyone around the would can be part of the GeoRGB community at the GRC platform, it means that the students and the instructors can post and publish content on the GRC platform, as well as, interact for learning and teaching. However, GRC cannot monitor all the activities in the GRC platform in real time, and things can go wrong; be aware of that and use the GRC platform at your own risk.  

GRC cannot guarantee the legality of any courses content, as well as neither, the reliability, validity, accuracy, or truthfulness of the courses. GRC does not take any review or edit of the courses in the GRC platform. When users get enrolled in a course, the users rely on any information provided by an instructor at their own risk.

When using the GRC platform users can be exposed to content that can be consider objectionable, indecent or offensive. To the extent permissible by law, GRC does not take any responsibility related to the access to any course or enroll in it by the users; when users decide to view content on the GRC platform, that is under their own risk.  

GRC cannot monitor the relation between the student and the instructor and vice versa. The users have to protect their own personal information and not share with other members of the GRC platform and if the users decide to share personal information, that is under their own risk and responsibility.

GRC does not recommend to share any type of personal information with an instructor for user’s safety.

GRC does not hire or employ any student or instructor and GRC is not liable and is not going to take any type of responsibility for their actions or conducts.

When using the RGC platform, the students and the instructors can provide the users access to other websites or other type of content outside of the GRC platform. Access to that kind of content is under the users’ own risk and GRC does not assume any responsibility or liability.

  1. Owned by GRC

GRC is the owner of the GRC platform (https://giscourse.online) and services offered in the GRC platform. The users cannot tamper or modify the GRC platform and associated services within GRC, without an authorized permit.

The GRC platform and services are protected by copyright, trademark, and other laws in each country. The users have no rights to use the GeoRGB or GeoRGB Community names or any of the GRC trademarks, logos, domain names, and other distinctive brand features.

  1. Applicable Laws and Jurisdiction

GeoRGB Community is a brand located at the province of Alberta in Canada, governed by the law of Alberta. The users who by their own decision want to use the GRC platform from a different country than Canada, they will do it under their own responsibility and their own risk.

If any user has a dispute, the GRC’s team will be happy to help the user solve it. If it is not possible to find a solution and the user lives in Canada, the options are to go to small claims in the Alberta court; you may not bring that claim in another court or participate in a non-individual class action claim against GeoRGB Community.
